MISSING_DOC_DATE test is incomplete

My XML has:

   <front> 
      <!-- SNIP -->
     <date/> 
     <!-- SNIP -->

Both2.17 and https://datatracker.ietf.org/doc/html/draft-iab-rfc7991bis-04#section-2.17 indicate this is legal. Plus I've been using it for years.
